To better protect your privacy, we provide this notice (the “Policy”) which applies to information provided or collected through this Site located at www.whitesmoke.com and in connection with WhiteSmoke's various services and software products (collectively, "Services").

Whitesmoke has been awarded TrustGuard's Privacy Seal signifying that this privacy policy and practices have been reviewed by TrustGuard for compliance with TrustGuard's program requirements including transparency, accountability and choice regarding the collection and use of your personal information. The TrustGuard program does not cover information that may be collected through downloadable software. This privacy policy covers the site www.whitesmoke.com. The Information We Collect.

We receive and store any information you enter on our website or give us in any other way (for example, through surveys, questionnaires, information provided at registration and in the course of other communications with us). When you register as a user of WhiteSmoke, you voluntarily provide information about yourself (such as name and e-mail address). In addition, when you use WhiteSmoke software or Services, the documents, text and information transmitted to us for analysis and correction is transferred to our servers, and this information may include personal information.

When you place an order on our site our merchant services provider requests certain personally identifiable information on the order form. You must provide contact information (such as name, e-mail address, and shipping address) and financial information (such as credit card number and expiration date). The merchant services provider processing the order will use this information for billing purposes, for filling your orders and as described in the merchant services provider's privacy policy. If there is a problem in processing an order, we or they may use information provided at registration to contact you.

The amount of personally identifying information you provide is up to you, and you are not obligated to provide such information. However, your use of the Site or the Services may be affected if such information is not provided.

You may provide information on behalf of another entity. If you completed the registration or provide information on behalf of a certain entity, you represent to us that you were authorized by that entity to give us consent to use the submitted information.

If you sign up for our Affiliate program you are transferred to a third party site, all of the Personal Information is collected on the third party site and is governed by their privacy policy. Your personal information is then shared back with Whitesmoke for the purpose of fulfilling your request to become an Affiliate.

We also may collect certain non-personally identifying information when you visit our Site or use the Services, such as your IP address, the type of browser you are using, the type of operating system you are using and access times. We also may collect information about your online activity. We may use third party contractors to collect and aggregate this information. The Site and Services are directed to a general audience and we do not offer services directed to children. If we gain actual knowledge that a child under the age of 13 has provided any personal information to us, we will immediately delete this information.

We do obtain the customers’ consent via e-mail prior to posting the testimonial to post their name along with their testimonial. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

How We Use the Information.

We and our affiliates may use personal information provided to us to as follows:

  • To enable us to verify your credentials, in order to maintain reasonable security, provide developers with the information that is useful in developing new features and services for our users, allow us to potentially vary advertising based on user preference, usage preferences and demographics, enable us to develop and improve the features, contents, and services available, fulfill your requests for our products and Services, in connection with your use of the Site or Services, to respond to your inquiries about our offerings, to offer you our products or services that we believe may be of interest to you, to carry out transactions which you have requested, to enforce our rights and resolve disputes.

Information Sharing and Disclosure.

  • Third-party vendors who provide services to us or facilitate or evaluate the Sites or Services, such as shipping companies to fulfill orders, and credit card processing companies billing for goods and services, live chat providers assisting our clients with the checkout process or if they have questions or concerns regarding our products or services, e-mail service providers sending e-mails on our behalf, and a third party vendors who hosting our shopping cart. Our merchant service provider's privacy policy governs the collection and use of the information collected within the shopping cart area of the Whitesmoke Web site; our service provider just hosts the platform and neither we nor our service provider have access to the information collected by the merchant service provider. We may also authorize third-party vendors or service providers to collect information on our behalf.
  • Business partners with whom we may jointly offer products or services, or whose products or services may be offered on our website or together with our software. Other than as set out above, you will be notified when personal information about you will be shared with third parties, and you will have an opportunity to choose not to have us share such information. WhiteSmoke does not sell, rent or lease the personal information that you provide about yourself to third parties unless we have your consent.

By providing personal information or using our Site or Services, you consent to transfer of information outside your country in connection with the transfers of information described in this Privacy Policy, even to countries that might not offer a level of protection for your personal information that is equivalent to the one offered in your country of residence.

Cookies and other technologies

Cookies are small data text files and can be stored on your computer’s hard drive (if your Web browser permits). This website uses cookies for the following general purposes:

Clear Gifs (Web Beacons/Web Bugs)

Our third party advertising partner employs a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customer’s personally identifiable information.

Our Commitment to Security. Physical and electronic procedures have been put into place to safeguard and help prevent unauthorized access, maintain data security, and correctly use personal information. These include use of firewalls, passwords and other measures.

Tell-A-Friend

If you choose to use our referral service to e-mail a friend about our Web site, we will ask for your friend’s name and e-mail address. We will automatically send your friend a one-time-e-mail inviting them to visit the Whitesmoke Site. We use the Addthis widget to allow you to e-mail a friend about our blog or the Whitesmoke site as well as to share the information on other sites. We do not store any of the information that is collected within this widget. The Addthis privacy policy governs the collection and use of the information that is collected. Your friend’s personal information is not stored on our database for any purpose.

Plagiarism Checker

If you choose to use the Plagiarism Checking Service in any of our solutions, the text you enter will be searched against an online database. This database is maintained by our partners and text may be retained in their systems. Only text entered in the Plagiarism search will be forwarded, without any additional information about the user.

Information Posted in Public Forums

If you use the blog on this site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these blogs and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these blogs.
